Ara b\u00e9, tamb\u00e9 s\u2019especifica que ser\u00e0 considerat temps efectiu de treball quan aix\u00ed estigui establert en el conveni col\u00b7lectiu o el contracte de treball.<\/p>\n<p>\u00c9s a dir, que <strong>dependr\u00e0 del tipus de jornada que tingui el treballador i del que s\u2019estableix en el seu conveni col\u00b7lectiu<\/strong> el que els seus temps de descans siguin considerats com a temps de treball.<\/p>\n<p>De les diferents jornades de treball que es contemplen (completa, a temps parcial, partida i cont\u00ednua), tan sols quan es treballen 6 hores de forma continuada existeix l\u2019obligaci\u00f3 d\u2019establir un descans m\u00ednim de 15 minuts, que <strong>en qualsevol cas haur\u00e0 de venir reflectit en conveni<\/strong>.<\/p>\n<h3>Jornada Completa<\/h3>\n<p>\u00c9s la m\u00e9s habitual i es realitzen 40 hores setmanals distribu\u00efdes en 8 hores di\u00e0ries. En aquest cas, els treballadors poden tenir dret o no a la pausa de l\u2019entrep\u00e0, si aix\u00ed ho estableix el seu conveni col\u00b7lectiu o contracte i si aquesta jornada es realitza de manera cont\u00ednua o partida.<\/p>\n<ul>\n<li>JORNADA PARTIDA: est\u00e0 relacionada amb els contractes a jornada completa i inclou una interrupci\u00f3 no retribu\u00efda d\u2019almenys una hora en la jornada laboral. Com en cap moment s\u2019excedeixen les 6 hores de treball continuat, <strong>no existeix obligaci\u00f3 d\u2019establir un descans retribu\u00eft<\/strong>.<\/li>\n<li>JORNADA CONT\u00cdNUA: \u00e9s tamb\u00e9 molt com\u00fa. Quan el treballador fa una jornada laboral cont\u00ednua de 6, 7 o 8 hores, <strong>t\u00e9 dret a la pausa m\u00ednima de 15 minuts<\/strong>, que ser\u00e0 de m\u00ednim 30 minuts si el treballador t\u00e9 menys de 18 anys. Aquesta pausa ser\u00e0 considerada temps de treball.<\/li>\n<\/ul>\n<h3>Jornada Parcial<\/h3>\n<p>Aquest tipus de jornada no podr\u00e0 superar les 30 hores setmanals, per\u00f2 s\u00ed que pot donar lloc al fet que es desenvolupin 6 hores de forma continuada. Si \u00e9s aix\u00ed, tamb\u00e9 caldria establir en conveni una pausa per a l\u2019entrep\u00e0 d\u2019almenys 15 minuts.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"35\" data-lineheight=\"42.349998px\"><span id=\"En_cas_d8217accident_durant_el_descans_quan_es_considera_accident_de_treball\">En cas d\u2019accident durant el descans, quan es considera accident de treball?<\/span><\/h2>\n<p>Doncs b\u00e9, aquest descans reconegut en les jornades continuades de 6 hores o m\u00e9s, <strong>serveix precisament per a recuperar-se del cansament acumulat<\/strong> i reduir els accidents de treball i, per aquesta ra\u00f3, \u00e9s considerat temps de treball.<\/p>\n<p>Si tenim en compte que es considera accident laboral aquell que el treballador sofreixi amb ocasi\u00f3 o a conseq\u00fc\u00e8ncia del treball que executi per compte d\u2019altri, <strong>l\u2019accident sofert durant el descans del treballador ser\u00e0 considerat accident laboral, sempre que aquest descans sigui considerat temps de treball<\/strong>.<\/p>\n<p>A tenir en compte:<\/p>\n<ul>\n<li><strong>Correspon a l\u2019ocupador la c\u00e0rrega de la prova<\/strong>, si pret\u00e9n desvirtuar la relaci\u00f3 de causalitat entre el treball realitzat i l\u2019accident o la lesi\u00f3 soferta.<\/li>\n<li>En els accidents de treball, <strong>s\u2019exigeix que les lesions se sofreixin durant el temps i el lloc de treball<\/strong>. trobes fora del teu lloc de treball?<\/span><\/h2>\n<p>Nombroses sent\u00e8ncies consideren accidents de treball els esdevinguts en circumst\u00e0ncies molt diverses: en vestuaris, aparcaments, en un passad\u00eds, en algun lloc del recinte de l\u2019empresa, etc., amb la qual cosa <strong>no cal que el treballador es trobi en el lloc prec\u00eds on executa la seva tasca professional<\/strong>.<\/p>\n<h3 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"24\" data-lineheight=\"36px\"><span id=\"Exemples_dalguns_d8217aquests_tipus_d8217accidents_de_treball\"><strong>Exemples d\u00b4alguns d\u2019aquests tipus d\u2019accidents de treball:<\/strong><\/span><\/h3>\n<p><span style=\"color: #00a6d7;\"><strong>1.-<\/strong><\/span> Els que sofreixi el treballador en anar o en tornar del lloc de treball.<\/p>\n<p><strong><span style=\"color: #00a6d7;\">2.-<\/span> <\/strong>Els que sofreixi el treballador amb ocasi\u00f3 o a conseq\u00fc\u00e8ncia de l\u2019acompliment de c\u00e0rrecs electius de car\u00e0cter sindical.<\/p>\n<p><span style=\"color: #00a6d7;\"><strong>3.-<\/strong><\/span> Els ocorreguts amb ocasi\u00f3 o per conseq\u00fc\u00e8ncia de les tasques que, fins i tot sent diferents a les del seu grup professional, executi el treballador en compliment de les ordres de l\u2019empresari o espont\u00e0niament en inter\u00e8s del bon funcionament de l\u2019empresa.<\/p>\n<p><span style=\"color: #00a6d7;\"><strong>4.-<\/strong> <\/span>Els esdevinguts en actes de salvament i en uns altres de naturalesa an\u00e0loga, quan els uns i els altres tinguin connexi\u00f3 amb el treball.<\/p>\n<h3>En l\u2019apartat de malalties, \u00e9s interessant con\u00e8ixer que tamb\u00e9 es consideren accidents de treball en alguns casos:<\/h3>\n<p><span style=\"color: #00a6d7;\"><strong>5.-<\/strong> <\/span>Les malalties que contregui el treballador amb motiu de la realitzaci\u00f3 del seu treball.<\/p>\n<p><span style=\"color: #00a6d7;\"><strong>6.-<\/strong><\/span> Les malalties o defectes, patits amb anterioritat pel treballador, que s\u2019agreugin a conseq\u00fc\u00e8ncia de la lesi\u00f3 constitutiva de l\u2019accident, etc.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"35\" data-lineheight=\"42.349998px\"><span id=\"Si_sofreixes_un_infart_o_un_ictus_durant_el_descans_tambe_es_considera_accident_laboral\">Si sofreixes un infart o un ictus durant el descans, tamb\u00e9 es considera accident laboral?<\/span><\/h2>\n<p>En els casos de lesions card\u00edaques i cerebrals, <strong>s\u2019at\u00e9n especialment la presumpci\u00f3 de laboralidad<\/strong> i, per tant, es consideren accidents de treball, tret que l\u2019ocupador aconsegueixi demostrar la falta de connexi\u00f3 amb el treball.<\/p>\n<p>Tampoc el fet que siguin malalties de car\u00e0cter com\u00fa \u00e9s un impediment perqu\u00e8 siguin considerades accidents de treball, ja que <strong>s\u2019ent\u00e9n que les condicions de treball contribueixen a la producci\u00f3 d\u2019aquestes<\/strong>.<\/p>\n<h2 class=\"fusion-responsive-typography-calculated\" data-fontsize=\"35\" data-lineheight=\"42.349998px\"><span id=\"I_que_passa_si_estas_teletreballant\"><strong>I qu\u00e8 passa si est\u00e0s teletreballant?<\/strong><\/span><\/h2>\n<p>El temps de descans establert per a jornades de 6 hores d\u2019ara endavant tamb\u00e9 \u00e9s aplicable al teletreball i, per tant, <strong>els accidents ocorreguts durant el teletreball en aquests per\u00edodes de descans, haurien de ser considerats accidents de treball<\/strong>.<\/p>\n<p>No obstant aix\u00f2, si ja el fet de teletreballar <a href=\"\/ca\/blog\/accident-laboral-teletreballant\/\">suposa algunes dificultats afegides<\/a> en cas d\u2019accident, ser\u00e0 doblement complicat que la m\u00fatua de treball reconegui com a accident laboral el produ\u00eft en una pausa de l\u2019entrep\u00e0, en la nostra pr\u00f2pia casa.<\/p>\n<p>Per tant, <strong>procura documentar tot de la forma m\u00e9s detallada possible<\/strong>, lloc i moment exacte, presa de fotografies, etc., i tingues en compte que no es reconeixen com a accident laboral les lesions produ\u00efdes per la manipulaci\u00f3 d\u2019un electrodom\u00e8stic o un ganivet, ja que s\u00f3n instruments aliens al treball.<\/p>\n<blockquote>\n<p><span style=\"color: #00a6d7;\"><strong>CONSELL ONANDIA<\/strong>: <\/span>davant la
