Tota una s\u00e8rie de trastorns que es troben darrere de nombroses baixes laborals i, desgraciadament tamb\u00e9, de no pocs su\u00efcidis.<\/p>\n<p>No obstant aix\u00f2, no sempre s&#8217;admet que el <strong>su\u00efcidi<\/strong> ha estat provocat per problemes o situacions originades en el treball. De fet, <strong>ser\u00e0 necessari provar que existeix un nexe de causalitat entre el su\u00efcidi i el context laboral de la v\u00edctima<\/strong>, perqu\u00e8 pugui ser considerat accident laboral.<\/p>\n<h2><strong>Factors psicosocials que causen baixes laborals i poden conduir al su\u00efcidi<\/strong><\/h2>\n<p>S&#8217;estima que a Europa prop d&#8217;un <strong>25% de les baixes m\u00e8diques<\/strong> tenen el seu origen en factors psicosocials: estr\u00e8s laboral \u2013l&#8217;alta incid\u00e8ncia del qual en el m\u00f3n laboral <a href=\"https:\/\/onandia-abogados.com\/ca\/blog\/estres-com-a-accident-laboral\/\">hem tractat ja en aquest blog<\/a>\u2013, assetjament en el treball, depressi\u00f3 sobrevinguda, etc.<br \/>\nSi ens atenim a les xifres, segons l&#8217;Organitzaci\u00f3 Internacional del Treball (OIT), un de cada 10 treballadors \u00e9s v\u00edctima d&#8217;assetjament laboral o <em>assetjament psicol\u00f2gic<\/em>, i de 100 casos que es presenten, 75 s\u00f3n dones.<\/p>\n<ul>\n<li><strong>Situacions d&#8217;assetjament que condueixen a l&#8217;estr\u00e8s i la depressi\u00f3<\/strong>: no es tracta d&#8217;un succ\u00e9s a\u00efllat, sol ser un proc\u00e9s que es desenvolupa al llarg de mesos o fins i tot anys, amb episodis de discriminaci\u00f3, amenaces, sobrec\u00e0rrega de treball, ocultaci\u00f3 d&#8217;informaci\u00f3, boicot, etc.<\/li>\n<li><strong>Conseq\u00fc\u00e8ncies f\u00edsiques i psicol\u00f2giques de l&#8217;estr\u00e8s i la depressi\u00f3 en el treballador<\/strong>: malalties del cor, hipertensi\u00f3, gastritis, malalties de la pell, maldecaps, problemes afectius, de somni i sexuals, a\u00efllament, etc.<\/li>\n<li><strong>Conseq\u00fc\u00e8ncies directes dels problemes psicosocials dels treballadors en la producci\u00f3 de l&#8217;empresa<\/strong>: absentisme, rotaci\u00f3 del personal, disminuci\u00f3 de la productivitat, mal funcionament entre departaments, deterioraci\u00f3 del servei d&#8217;atenci\u00f3 al client, etc.<\/li>\n<\/ul>\n<p>Fins avui, <strong>cap d&#8217;aquests factors psicosocials est\u00e0 reconegut com a origen o conseq\u00fc\u00e8ncia d&#8217;una malaltia professional<\/strong>en el nostre ordenament ni en el de molts pa\u00efsos europeus i, no obstant aix\u00f2, l&#8217;agreujament d&#8217;aquestes malalties pot conduir, en casos molt greus, al <strong>su\u00efcidi<\/strong>.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-2 fusion-flex-container has-pattern-background has-mask-background nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start fusion-flex-content-wrap\" style=\"max-width:1352px;margin-left: calc(-4% \/ 2 );margin-right: calc(-4% \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-1 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:100%;--awb-margin-top-large:0px;--awb-spacing-right-large:1.92%;--awb-margin-bottom-large:20px;--awb-spacing-left-large:1.92%;--awb-width-medium:100%;--awb-order-medium:0;--awb-spacing-right-medium:1.92%;--awb-spacing-left-medium:1.92%;--awb-width-small:100%;--awb-order-small:0;--awb-spacing-right-small:1.92%;--awb-spacing-left-small:1.92%;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div style=\"text-align:center;\"><a class=\"fusion-button button-flat button-xlarge button-default fusion-button-default button-1 fusion-button-default-span fusion-button-default-type boton-negrita\" target=\"_self\" href=\"tel: 934 88 11 25 \"><span class=\"fusion-button-text awb-button__text awb-button__text--default\">Has tingut un accident? T\u2019informem GRATIS: 934 88 11 25<\/span><i class=\"fa-chevron-right fas awb-button__icon awb-button__icon--default button-icon-right\" aria-hidden=\"true\"><\/i><\/a><\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-3 fusion-flex-container nonhundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row fusion-flex-align-items-flex-start fusion-flex-content-wrap\" style=\"max-width:1352px;margin-left: calc(-4% \/ 2 );margin-right: calc(-4% \/ 2 );\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-2 fusion_builder_column_1_1 1_1 fusion-flex-column\" style=\"--awb-bg-size:cover;--awb-width-large:100%;--awb-margin-top-large:0px;--awb-spacing-right-large:1.92%;--awb-margin-bottom-large:20px;--awb-spacing-left-large:1.92%;--awb-width-medium:100%;--awb-spacing-right-medium:1.92%;--awb-spacing-left-medium:1.92%;--awb-width-small:100%;--awb-spacing-right-small:1.92%;--awb-spacing-left-small:1.92%;\"><div class=\"fusion-column-wrapper fusion-flex-justify-content-flex-start fusion-content-layout-column\"><div class=\"fusion-text fusion-text-2\"><div class=\"fusion-text fusion-text-2\"><\/div>\n<h2><strong>En quins casos es considera que un su\u00efcidi \u00e9s accident laboral<\/strong><\/h2>\n<p>La <strong>jurisprud\u00e8ncia espanyola<\/strong> va considerar per primera vegada un<strong> su\u00efcidi com a accident laboral en 1970<\/strong>, any en qu\u00e8 el Tribunal Suprem va acreditar el nexe causal entre aquesta acci\u00f3 i el context laboral de la persona morta. <strong>Fins llavors, ni tan sols els su\u00efcidis esdevinguts en temps i lloc de treball tenien aquesta consideraci\u00f3<\/strong>; la voluntarietat de l&#8217;acte enervava la possibilitat de considerar-los accidents.<\/p>\n<p>Des de llavors, ja s\u00f3n <strong>nombroses les sent\u00e8ncies que han reconegut alguns su\u00efcidis<\/strong> (ocorreguts tant dins com fora del lloc de treball) <strong>com a accidents laborals<\/strong>, si b\u00e9 \u00e9s vital que la part contr\u00e0ria no sigui capa\u00e7 d&#8217;acreditar que existeixen causes alienes a l&#8217;activitat professional que hagin provocat el fatal desenlla\u00e7.<\/p>\n<blockquote>\n<p><span style=\"color: #f9c939;\"><strong>CONSELL ONANDIA<\/strong><\/span>: la clau, llavors com ara, est\u00e0 a <strong>demostrar que existeix aquest nexe de causalitat<\/strong>. Ser\u00e0 imprescindible l&#8217;actuaci\u00f3 de l&#8217;advocat a l&#8217;hora de recaptar informes, localitzar els indicis necessaris i demostrar, negre sobre blanc, que existeix aquesta relaci\u00f3. En molts casos, est\u00e0 en joc la subsist\u00e8ncia de la fam\u00edlia directa del mort.<\/p>\n<\/blockquote>\n<h3><strong>EL NEXE DE CAUSALITAT<\/strong><\/h3>\n<p>Qu\u00e8 hem d&#8217;acreditar? <strong>Que la situaci\u00f3 emocional que ha determinat la decisi\u00f3 del su\u00efcidi es troba directament relacionada amb la situaci\u00f3 laboral del treballador<\/strong>, les seves condicions de treball o alguna circumst\u00e0ncia professional. En definitiva, que la persona adopta aquesta decisi\u00f3, fruit de l&#8217;angoixa que viu en el treball.<\/p>\n<p>De fet, tot i que el su\u00efcidi es produeix en el lloc de treball (que permet presumir el car\u00e0cter laboral del mateix), aquesta presumpci\u00f3 admet prova en contra. <strong>Si la part contr\u00e0ria \u00e9s capa\u00e7 d&#8217;argumentar que existeixen altres causes desencadenants<\/strong> (una situaci\u00f3 personal dif\u00edcil, una defunci\u00f3 familiar, una depressi\u00f3 pr\u00e8via, intents anteriors, etc.), <strong>seran els familiars del mort els que hagin de demostrar el nexe de causalitat<\/strong>.<\/p>\n<h3><strong>ALGUNS EXEMPLES DE CASOS ON S&#8217;HA TROBAT EL NEXE DE CAUSALITAT EN EL SU\u00cfCIDI<\/strong><\/h3>\n<ul>\n<li>Figura el cas d&#8217;un <strong>conductor d&#8217;autobusos de Sevilla<\/strong> que es trobava immers en un proc\u00e9s legal contra l&#8217;empresa despr\u00e9s d&#8217;haver participat en una vaga. El Tribunal Suprem va recon\u00e8ixer en 2013 el seu su\u00efcidi com a accident laboral.<\/li>\n<li>Aix\u00ed mateix, en sent\u00e8ncia de la Sala social del TSJ de Catalunya d&#8217;11 d&#8217;abril de 2014, aquest tribunal reconeix com a accident de treball el <strong>su\u00efcidi d&#8217;un agent forestal<\/strong> esdevingut fora del lloc i l&#8217;hora de treball. Ent\u00e9n la Sala que la seva participaci\u00f3 en l&#8217;extinci\u00f3 d&#8217;un incendi forestal, amb el qual es va obsessionar, ha de considerar-se la causa de la depressi\u00f3 que sofria i que li va conduir al su\u00efcidi. D&#8217;aquesta manera, es reconeix el dret a la pensi\u00f3 de vidu\u00eftat i orfandat de l&#8217;esposa i fills.<\/li>\n<li>Tamb\u00e9 es va recon\u00e8ixer accident laboral el su\u00efcidi d&#8217;<strong>un treballador d&#8217;un banc al qual se li va obrir expedient disciplinari<\/strong> per actuacions irregulars amb repercussi\u00f3 penal, en sent\u00e8ncia de la Sala social del TSJ de Catalunya de 26 d&#8217;octubre de 2015.<\/li>\n<li>La mateixa consideraci\u00f3 va rebre el cas d&#8217;un <strong>vigilant de seguretat amb antecedents de psicopatia i baixa m\u00e8dica<\/strong>. No es va acreditar que aquestes malalties tinguessin relaci\u00f3 amb el lloc de treball, per\u00f2 aix\u00ed i tot es va estimar que existia accident laboral perqu\u00e8, segons el Tribunal, l&#8217;empresa degu\u00e9 adaptar el lloc de treball a la seva condici\u00f3 de salut depressiva. Sent\u00e8ncia de 2 de febrer de 2016 del Tribunal Superior de Just\u00edcia de Castella-la Manxa.&#8221;<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box
