estan recollides en la llista de Malalties Professionals, per\u00f2 que en molts casos apareixen i estan directament relacionades amb el <strong>treball,<\/strong> com \u00e9s el cas de <strong>l&#8217;estr\u00e8s<\/strong>.<\/p>\n<p>A partir de l&#8217;1 de gener de 2022, el <strong>bornout, o s\u00edndrome d&#8217;esgotament professional <\/strong>ocasionat per l&#8217;estr\u00e8s cr\u00f2nic en el treball, queda <strong>oficialment incorporat a la Classificaci\u00f3 Internacional de Malalties que publica l&#8217;OMS.<\/strong><\/p>\n<p>Actualment, gaireb\u00e9 la meitat dels treballadors europeus manifesta patir estr\u00e8s en el seu lloc de treball per exc\u00e9s de responsabilitat, inseguretat laboral, etc., i est\u00e0 comprovat que l&#8217;estr\u00e8s prolongat<strong> pot causar malalties <\/strong>cardiovasculars i musculoesquel\u00e8tiques greus.<\/p>\n<p>Arribats a aquest punt, cada vegada m\u00e9s sent\u00e8ncies consideren l&#8217;estr\u00e8s laboral com a accident de treball. <strong>La clau est\u00e0 a demostrar la relaci\u00f3 de causalitat entre el treball i l&#8217;estr\u00e8s laboral<\/strong>.<\/p>\n<h2><strong>S\u00edmptomes, causes i efectes de l&#8217;estr\u00e8s laboral<\/strong><\/h2>\n<p>L&#8217;estr\u00e8s \u00e9s una reacci\u00f3 natural de l&#8217;organisme, si b\u00e9, prolongat en el temps, pot causar efectes devastadors en l&#8217;organisme d&#8217;una persona.<\/p>\n<p>Existeixen <strong>nombrosos s\u00edmptomes fisiol\u00f2gics i cognitius<\/strong> que et poden ajudar a recon\u00e8ixer si el que sofreixes \u00e9s estr\u00e8s:<\/p>\n<ul>\n<li><strong>SENYALS PRIMERENCS<\/strong>: mal de cap, alteracions del descans, dificultat de concentraci\u00f3, geni alterat, est\u00f3mac descompost, descontent en el treball, \u00e0nim decaigut.<\/li>\n<li><strong>S\u00cdMPTOMES COGNITIUS<\/strong>: preocupaci\u00f3, inseguretat, por o temor, percepci\u00f3 negativa d&#8217;un mateix i de les decisions preses, por d&#8217;equivocar-se, dificultat per a pensar i actuar, ansietat i depressi\u00f3.<\/li>\n<\/ul>\n<h3><strong>S\u00cdNDROME DEL BORNOUT<\/strong><\/h3>\n<p><strong>La s\u00edndrome d&#8217;esgotament professional o bornout est\u00e0 ocasionat per l&#8217;estr\u00e8s cr\u00f2nic en el treball<\/strong> i es manifesta amb esgotament f\u00edsic i mental intens, falta d&#8217;energia i inter\u00e8s i, en conseq\u00fc\u00e8ncia, sota rendiment.<\/p>\n<p>Aquest estr\u00e8s cr\u00f2nic pot deure&#8217;s a diferents causes que defineixen la seva tipologia.<\/p>\n<h3><strong>TIPUS D&#8217;ESTR\u00c8S LABORAL<\/strong><\/h3>\n<ul>\n<li><strong>Estr\u00e8s per assetjament laboral o assetjament psicol\u00f2gic:<\/strong> et sents v\u00edctima d&#8217;estrat\u00e8gies d&#8217;incomunicaci\u00f3, intimidaci\u00f3, menyspreu, amenaces, fins i tot viol\u00e8ncia.<\/li>\n<li><strong>Estr\u00e8s posttraum\u00e0tic<\/strong>: es desencadena despr\u00e9s de patir algun accident en el treball.<\/li>\n<li><strong>Estr\u00e8s per sobrec\u00e0rrega o per exc\u00e9s de responsabilitat<\/strong>: tens m\u00e9s treball del que pots abastar, molta pressi\u00f3 per la responsabilitat del c\u00e0rrec, o les tasques superen els teus coneixements.<\/li>\n<li><strong>Estr\u00e8s per impot\u00e8ncia<\/strong>: tens la sensaci\u00f3 de no poder influir amb el teu treball en la situaci\u00f3 de l&#8217;empresa o d&#8217;haver perdut el control.<\/li>\n<li><strong>Estr\u00e8s per sensaci\u00f3 d&#8217;inestabilitat<\/strong>: tems perdre el teu treball, en un moment de crisi, per exemple, o b\u00e9 creus que les teves condicions laborals poden empitjorar.<\/li>\n<li><strong>Estr\u00e8s per falta de reconeixement o suport<\/strong>: sents que el que fas no es reconeix o potser no reps les directrius adequades ni el suport dels teus superiors.<\/li>\n<li><strong>Estr\u00e8s per avorriment o monotonia:<\/strong> et falten est\u00edmuls a causa d&#8217;un treball mon\u00f2ton i repetitiu.<\/li>\n<\/ul>\n<h3><strong>CONSEQ\u00dc\u00c8NCIES DE L&#8217;ESTR\u00c8S LABORAL PROLONGAT<\/strong><\/h3>\n<p>Sofrir estr\u00e8s laboral cr\u00f2nic passa factura, sens dubte, per\u00f2 no sols parlem de desgast emocional i esgotament f\u00edsic, tamb\u00e9 <strong>poden apar\u00e8ixer patologies m\u00e9s severes com la depressi\u00f3 o l&#8217;insomni, fins i tot problemes card\u00edacs o malalties digestives<\/strong> importants, per no parlar de consums d&#8217;alcohol i altres subst\u00e0ncies.<\/p>\n<p>No podem oblidar que la persona que funciona <strong>sota la pressi\u00f3 de l&#8217;estr\u00e8s cr\u00f2nic<\/strong> es veu obligada a realitzar altres activitats quotidianes per a les quals potser ja <strong>no est\u00e0 en les millors condicions<\/strong>. Parlem de <strong>conduir,<\/strong> per exemple.<\/p>\n<p>Segons un estudi realitzat per RACE en 2017, l&#8217;estr\u00e8s al volant <strong>augmenta un 28% el risc de patir un accident de tr\u00e0nsit<\/strong>. Les persones estressades deixen de veure un 20% dels senyals de tr\u00e0nsit, realitzen maniobres brusques i accelerades, i fins i tot el seu angle de visi\u00f3 es redueix a menys de 70 graus.<\/p>\n<p>Per tant, \u00e9s indubtable que l&#8217;estr\u00e8s cr\u00f2nic pot convertir-se en la causa de molts accidents laborals de tr\u00e0nsit o in itineri, com els soferts per aquells treballadors que compleixen al volant la seva jornada laboral (repartidors, taxistes, serveis t\u00e8cnics) o els ocorreguts en anar o tornar del treball.<\/p>\n<h3><strong>LES XIFRES DE L&#8217;ESTR\u00c8S LABORAL A ESPANYA<\/strong><\/h3>\n<p>Fa alguns anys,<strong> l&#8217;OMS estimava que en 2020<\/strong> l&#8217;ansietat i la depressi\u00f3 causades directament per l&#8217;estr\u00e8s laboral serien la<strong>primera causa de baixa laboral en el m\u00f3n<\/strong>.<\/p>\n<p>La realitat \u00e9s que, ara com ara, l<strong>&#8216;estr\u00e8s causa m\u00e9s del 30% de les baixes laboral<\/strong>s al nostre pa\u00eds i s&#8217;ha convertit en un problema de primera magnitud amb alts costos personals i laborals.<\/p>\n<p>Falta de suport, relacions deficients, dificultats financeres i de conciliaci\u00f3 estan darrere de l&#8217;estr\u00e8s, i est\u00e0 comprovat que e<strong>ls treballadors estressats s\u00f3n un 60% menys productius.<\/strong> No en va, cada vegada m\u00e9s iniciatives dins de les pr\u00f2pies empreses busquen promocionar la salut i el benestar dins del centre de treball, encara que nom\u00e9s un 25% d&#8217;elles han implantat mesures en aquest sentit.<\/p>\n<h2><strong>Baixa per estr\u00e8s laboral: com sol\u00b7licitar-la i amb quines prestacions<\/strong><\/h2>\n<p>Si la situaci\u00f3 s&#8217;allarga i es fa necessari sol\u00b7licitar una baixa, \u00e9s important demostrar que l&#8217;estr\u00e8s s&#8217;ha produ\u00eft per circumst\u00e0ncies inherents o relacionades amb el lloc de treball. \u00c9s a dir, que es tracta d&#8217;una baixa per conting\u00e8ncies professionals.<\/p>\n<ul>\n<li><strong>CONTING\u00c8NCIES COMUNES<\/strong>: en aquest cas, l&#8217;estr\u00e8s no est\u00e0 relacionat amb l&#8217;activitat laboral i es tractar\u00e0 com qualsevol altra malaltia comuna. Aquesta baixa per conting\u00e8ncies comunes comen\u00e7a a cobrar-se a partir del quart dia.<\/li>\n<li><strong>CONTING\u00c8NCIES PROFESSIONALS<\/strong>: quan la depressi\u00f3 o l&#8217;ansietat han estat provocades per l&#8217;estr\u00e8s que el pacient viu di\u00e0riament en la seva activitat laboral, ser\u00e0 la m\u00fatua de treball la que gestionar\u00e0 la incapacitat de treballar de l&#8217;empleat. Aquesta <strong>prestaci\u00f3 comen\u00e7a a cobrar-se l&#8217;endem\u00e0 de ser reconeguda aquesta baixa.<\/strong><\/li>\n<\/ul>\n<p>Durada de la baixa: aquest tipus de baixa per depressi\u00f3 o ansietat motivada per l&#8217;estr\u00e8s laboral es reconeix per un <strong>m\u00e0xim de 12 mesos<\/strong>, si b\u00e9 <strong>pot allargar-se 6 mesos m\u00e9s<\/strong> si el metge de la m\u00fatua el considera necessari. Transcorregut aquest termini extra, si la persona continua incapacitada, el seu cas haur\u00e0 de ser estudiat per un tribunal m\u00e8dic per si \u00e9s convenient concedir-li una incapacitat permanent.<\/p>\n<p>Prestaci\u00f3: en la baixa per conting\u00e8ncies professionals, <strong>es cobra el 75% de la base reguladora<\/strong> des de l&#8217;endem\u00e0 a la baixa.<\/p>\n<h2><strong>Jurisprud\u00e8ncia: qu\u00e8 diu el Tribunal Suprem de l&#8217;estr\u00e8s laboral com a accident de treball?<\/strong><\/h2>\n<p>Segons l&#8217;art. 156.1 de la Llei General de la Seguretat Social, es considera accident de treball \u00abtota lesi\u00f3 corporal que el treballador sofreixi amb ocasi\u00f3 o per conseq\u00fc\u00e8ncia del treball que executi per compte d&#8217;altri\u00bb.<\/p>\n<p>En aquest sentit, cada vegada m\u00e9s sent\u00e8ncies consideren l&#8217;estr\u00e8s com a accident laboral. Alguns exemples:<\/p>\n<ul>\n<li>Sent\u00e8ncia dictada per la sala social del Tribunal Superior de Just\u00edcia d&#8217;Andalusia que reconeix com a accident laboral el ictus sofert per un treballador sotm\u00e8s a un alt grau d&#8217;estr\u00e8s.<\/li>\n<li>Sent\u00e8ncia dictada pel Jutjat social de Bilbao que considera accident laboral l&#8217;estr\u00e8s posttraum\u00e0tic que va patir una treballadora d&#8217;una sucursal banc\u00e0ria despr\u00e9s de patir un atracament en aquesta.<\/li>\n<li><strong>QU\u00c8 DIU EL TRIBUNAL SUPREM<\/strong>: l&#8217;Alt Tribunal ha establert que es consideren accident laboral no sols els accidents en sentit estricte o les lesions que es produeixin a conseq\u00fc\u00e8ncia d&#8217;aquests, sin\u00f3 tamb\u00e9 les malalties que puguin originar-se en el treball. \u00c9s m\u00e9s, argumenta que quan es pretengui eliminar la presumpci\u00f3 de laboralidad en la qualificaci\u00f3 de la malaltia, haur\u00e0 de quedar acreditat de manera suficient.<\/li>\n<\/ul>\n<h2><strong>Com demostrar que l&#8217;estr\u00e8s \u00e9s el causant d&#8217;un accident laboral?<\/strong><\/h2>\n<p><strong>L&#8217;infart de miocardi degut a l&#8217;estr\u00e8s \u00e9s un dels accidents laborals m\u00e9s comuns<\/strong>, no obstant aix\u00f2, \u00e9s complicat establir el vincle entre la lesi\u00f3 i l&#8217;estr\u00e8s laboral.<\/p>\n<p>\u00c9s en la pr\u00f2pia llei (art. 156 de la Llei de Seguretat Social) i en la jurisprud\u00e8ncia on trobem els arguments per a defensar aquest vincle; no obstant aix\u00f2, ser\u00e0 un perit psic\u00f2leg el que hagi de realitzar un estudi per a determinar els motius del teu estat.<\/p>\n<p><strong>Perqu\u00e8 l&#8217;estr\u00e8s sigui qualificat com a accident de treball<\/strong> ha d&#8217;estar generat per un o diversos estressors objectius (s\u00f3n percebuts per subjectes externs a l&#8217;organitzaci\u00f3) i han de considerar-se com a necessaris i suficients per a generar el quadre d&#8217;estr\u00e8s laboral.<\/p>\n<h3><strong>PUC DEMANDAR A l&#8217;EMPRESA PER ESTR\u00c8S LABORAL I ACONSEGUIR UNA INDEMNITZACI\u00d3?<\/strong><\/h3>\n<p>Arribat el cas, caldr\u00e0 demostrar que aquest estr\u00e8s que ha trastocat la nostra vida totalment ha estat provocat per alguns factors interns o externs relacionats amb l&#8217;activitat laboral, fins i tot que en alguns casos \u00e9s responsabilitat directa de l&#8217;ocupador, o aquest no ha posat de la seva part per evitar-los.<\/p>\n<blockquote>\n<p>CONSELL ONANDIA: cal dir que totes les empreses tenen una responsabilitat exigible per part del treballador, relativa a la prevenci\u00f3 de possibles riscos laborals als quals estan exposats els seus empleats.<strong> Es pot aconseguir una indemnitzaci\u00f3 justa amb una demanda ben argumentada.<\/strong><\/p>\n<\/blockquote>\n<p>L&#8217;Estatut dels Treballadors \u00e9s bastant clar quan especifica que \u00abl&#8217;empresari que organitzi el treball [\u2026] haur\u00e0 de tenir en compte el principi general d&#8217;adaptaci\u00f3 del treball a la persona, especialment de cara a atenuar el treball mon\u00f2ton i repetitiu en funci\u00f3 de la mena d&#8217;activitat i de les exig\u00e8ncies en mat\u00e8ria de seguretat i salut dels treballadors\u00bb.<\/p>\n<p>Aix\u00ed, una possible demanda haur\u00e0 de provar la causa de l&#8217;estr\u00e8s laboral que sofreix aquesta persona, i aquesta ser\u00e0 la major dificultat en emprendre accions legals, fonamentar aquesta causa. No \u00e9s el mateix parlar d&#8217;un cas de bore out (estr\u00e8s per avorriment i falta d&#8217;activitat adequada) que d&#8217;un quadre d&#8217;estr\u00e8s laboral generat per assetjament psicol\u00f2gic (en el qual l&#8217;ocupador pot haver degradat al seu empleat amb tasques molt per sota de la categoria per a la qual va ser contractat).<\/p>\n<h3><strong>EN CAS DE DEFUNCI\u00d3 PER ESTR\u00c8S LABORAL, T\u00c9 LA FAM\u00cdLIA DRET A INDEMNITZACI\u00d3?<\/strong><\/h3>\n<p>Si finalment es produeix la defunci\u00f3 de la persona que ha sofert, per exemple, un infart a causa de l&#8217;estr\u00e8s laboral, la fam\u00edlia haur\u00e0 d&#8217;assumir les conseq\u00fc\u00e8ncies no sols personals sin\u00f3 econ\u00f2miques, ja que en algun cas pot quedar-se sense la seva principal font d&#8217;ingressos.<\/p>\n<p>Si s&#8217;aconsegueix el reconeixement com a accident laboral, \u00e9s possible aconseguir les indemnitzacions oportunes.<\/p>\n<blockquote>\n<p>CONSELL
